Over 50 combined years of practice have taught us a couple of things. One of the most important is that much commercial litigation is both unnecessarily expensive and avoidably inefficient. So when we set up Cerulean Chambers we decided to do things differently.
First and foremost we aimed to conduct commercial litigation in a much more efficient way by removing the duplication inherent in traditional practices. We decided to do this by aiming our services primarily straight at our commercial clients without the need for them to go through an intermediary law firm. To do this we had to address several issues.
We are barristers who traditionally only do the sharp end of litigation as advocates. But the members of Cerulean have always had a much more hands on approach, ensuring that they also understand and can do the backroom side of litigation. So we are now awaiting approval from the Bar Standards Board (BSB) to carry out all the functions of litigation for our clients. The result will be that there is one set of lawyers handling our clients’ cases throughout, from taking initial instructions, providing specialist advice, issuing proceedings, assembling documents and ultimately, if necessary, conducting the case in court.
Our costs models shown that our approach is likely to save our clients up to 50% in professional fees.
We have also addressed the vexed issue of the cost of disbursements and the sometimes variable quality of ancillary work undertaken in the course of litigation such as obtaining expert advice, translation of case documents (we do a lot of international work), IT specialists to sort out electronic disclosure and production of court bundles.
The solution is to use only the leaders in their fields. We have a worldwide network of experts who provide us with high-quality advice when required. For cases involving foreign law and courts we can turn to lawyers with whom we have worked and whom we trust. For translation we use court approved translators who always translate into their native language, but many of whom are bilingual. And for the management of electronic and hard copy documents, always a key task, we have close working arrangements with one of the country’s leading specialist firms.
